BREACH A breach occurs when a person fails to fulfill a duty owed to another person. Thus, to keep a dangerous animal is a breach of the duty owed to passersby and other people exposed to injury from the animal. Similarly, a doctor who neglects to treat an illness or injury, or who pursues the wrong treatment for an injury or illness is in breach of the duty of care owed to the patient; a lawyer who fails to file necessary paperwork in a case is in breach of the duty owed by an attorney to his client, and an accountant who files incorrect paperwork is in breadh of a duty owed by an accountant to a client.
