DUTY. Duty is an obligation owed to another person. For example, a doctor owes a duty of care to a patient; the doctor must adhere to recognized standards of care in treating a patient. Similarly, an attorney or accountant must follow the rules of the profession in keeping a client's accounts, in prosecuting or defending a civil case or defending a criminal case, and so on. A duty may also be general; thus, a driver owes a duty to every other driver on the road not to drive drunk and to observe the traffic rules.
